Anden begrundelse: Due to technical necessity, the transportation system for the Nordhavn Extension can only be supplied by the existing supplier of the M4 line. This technical exclusivity justifies the award of the contract for the transportation system for the Nordhavn Extension to that supplier without prior publication, pursuant to Article 50(c)(ii) of the Utilities Directive. The reasons for this are explained in further detail below. A metro system constitutes an integrated, safety-critical transport system in which signalling and ATC systems, on-board train control equipment, radio communication, central traffic control and safety logic are designed, implemented and safety-certified as a single, coherent technical architecture. In practice, full interoperability between an existing installed CBTC system and an extension system supplied by different suppliers does not exist, as they rely on communication interfaces, positioning methods and safety architectures that cannot operate seamlessly together. The introduction of a second transportation system supplier for the Nordhavn Extension would require the coexistence and interaction of two parallel control and safety systems, which would necessitate complex and largely untested interfaces between two parallel systems and fundamentally undermine the integrity of the safety concept. Metro trains cannot dynamically switch between control systems, and any change of supplier would require complex and safety-critical interface arrangements to determine when and how control of the trains is transferred between the respective systems. The deployment of two different ATC systems, each of which is closely and inherently integrated with the remaining subsystems of the transportation system, would create a material risk that one system could attempt to assume control of the trains on incorrect sections of the line. There would be a significant risk that the systems would fail to reliably and consistently exchange essential and safety- and operations-critical information, including train position, speed, routing, timing of platform screen door operations, operational faults and alarms, or ensure the correct response thereto. Interface management would be further complicated by the fact that train communications would be handled by two separate systems responsible for different sections of the line, while overall operations are centrally managed from a single control center. In practice, such interface management between two parallel control and communication systems is not technically feasible without introducing a material risk of communication failures, which would compromise both operational reliability and system safety. Given the exceptionally stringent requirements for obtaining safety approval, the operation of two parallel transportation systems would prevent such approval from being granted. Safety authorities require a single clearly defined system architecture, a unified safety case and an unambiguous allocation of safety responsibility, which cannot realistically be achieved where two suppliers apply different safety philosophies, hazard analyses, validation methods and change management processes. Any interface between the two systems would itself be safety-critical and would require comprehensive regulatory approval, for which no mature or proven equivalent reference exists in metro operations. Consequently, the probability of obtaining regulatory safety approval for operating two parallel transportation systems on the same line is very unlikely. For reasons of technical necessity, system safety and regulatory compliance, it is therefore necessary that the same transportation system supplier be used on the existing line and its extension. Metroselskabet has assessed whether any credible and economically viable alternatives exist to awarding the contract to the existing supplier, including the replacement and re-tendering of the entire transportation system for the M3 and M4 lines, which are operationally interconnected and operate on the same transportation system. The M3 and M4 lines together constitute a substantial part of the metro network, comprising 25 stations and approximately 27 kilometres of double track, the majority of which is in tunnel. Replacing the entire transportation system would require prolonged closure of the M3 and M4 lines and would result in exorbitant economic losses due to forgone revenue. On this basis, Metroselskabet concludes that replacement of the existing transportation system would entail disproportionate economic and technical consequences, as it would necessitate the premature decommissioning of a fully operational system with significant remaining service life, leading to exorbitant costs and a substantial loss of value.
